Welcome to the online store of Wellness Satiety (Pty) Ltd (“Company”, “we”, “us”, or “our”). We manufacture and retail the Wellness Satiety Meal. These Terms and Conditions (“Terms”) govern your use of our website www.wellnesssatiety.co.za (the “Site”) and the purchase of any products from our online store.

By accessing our Site and placing an order, you agree to be legally bound by these Terms. Please read them carefully before purchasing. These Terms comply with the South African Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

1. Product description and packaging.

The Wellness Satiety Meal is a formulated meal replacement product. Each standard commercial package contains 7 individual meals. Each meal portion consists of 2 dried satiety rusks/biscuits individually sealed in a packet (total weight of approximately 45 g per meal). Because our meals are baked goods containing natural dietary fibres and ingredients, minor variations in colour, shape, and texture may occur between batches. These natural variations do not affect the efficacy or quality of the product.

2. Health and efficacy disclaimer.

The Wellness Satiety Meal is designed and formulated to promote satiety (keeping you full for an estimated 4 to 6 hours). However, individual physiological responses vary:
 

• No medical guarantees: Results regarding fullness can vary depending on individual metabolism, lifestyle, physical activity, and overall diet. We do not guarantee uniform results for every user.
• Not a medical substitute: This product is a nutritional meal replacement and is not a medicine. It is not intended to diagnose, treat, cure, or prevent chronic medical conditions. Professional consultation: If you are diabetic, insulin-dependent, pregnant, breastfeeding, or have a chronic medical condition, consult your medical practitioner or a registered dietitian before replacing meals with this product.

3. Allergen warning.

Our Wellness Satiety Meals are produced in a facility that handles common dietary allergens.
 

• Potential allergens: The product may contain or come into contact with wheat, gluten, dairy, tree nuts, peanuts, soy, sesame seeds, eggs, and oats.
• Customer responsibility:It is the customer's strict responsibility to read the packaging label and full ingredient list prior to consumption. If you suffer from severe food allergies or celiac disease, please exercise caution.

4. Agreement of sale and pricing.

• Order finalisation:In terms of the ECTA, an agreement of sale is only concluded once you have placed an order, payment has been successfully processed and cleared in our bank account, and we have sent you an order dispatch confirmation.
• Pricing: All prices displayed on the Site are quoted in South African Rand (ZAR). Prices are inclusive of Value Added Tax (VAT) if applicable, but exclusive of delivery charges, which will be calculated and displayed at checkout.

5. Secure payment methods.

Payment must be made in full before your order is dispatched. We use secure, PCI-compliant third-party payment gateways to protect your financial data. We accept: 

• Credit and Debit Cards (Visa, MasterCard)
• Secure Instant EFT via PayFast

6. Shipping, delivery, and disk delivery areas.

For example: We deliver across South Africa via our designated third-party courier partners or we have physical pickup points in both Bloemfontein and Cape Town.

Processing & Timelines: Orders are generally processed within [1–3] business days. Delivery to main hubs (Johannesburg, Durban) typically takes [2–3] business days, while regional/rural areas may take longer. Risk of Loss: In accordance with the CPA, the risk of loss, damage, or deterioration of the product passes to you upon physical delivery of the package to your specified delivery address.

7. Cancellations, returns, and refunds.

Because the Wellness Satiety Meal is a perishable food product, specific restrictions apply under Section 20 of the CPA regarding public health and hygiene safety:
 

• Cooling-Off period and cancellations: Under the ECTA, you may cancel your transaction without penalty within 7 days of receiving the goods, provided the outer package box and individual meal packets remain completely unopened, undamaged, and in their original sealed condition. You will be liable for the direct cost of returning the goods to us.
• Opened food products: For safety, hygiene, and health reasons, we cannot accept returns, exchanges, or refunds for any packages where the external seal or the individual 2-biscuit meal packets have been opened, broken, or tampered with, unless the product is proven to be defective at the time of delivery.

8. Storage, shelf life, and product integrity.

The Wellness Satiety Meal contains specific fibres and active components formulated for satiety support. To maintain freshness and efficacy, the product must be stored in a cool, dry place away from direct sunlight. Once an individual 45 g packet is opened, the 2 meals should be consumed immediately or stored in an airtight container. We are not liable for product degradation, staleness, or spoilage caused by improper customer storage.

9. Privacy and data protection. (POPIA)

We respect your privacy and are committed to protecting your personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). Any personal details collected during checkout will strictly be used to process your order, arrange delivery, and communicate relevant product updates. We will never sell or share your data with unauthorised third parties.

10. Intellectual property.

We respect your privacy and are committed to protecting your personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). Any personal details collected during checkout will strictly be used to process your order, arrange delivery, and communicate relevant product updates. We will never sell or share your data with unauthorised third parties.

11. Limitation of liability.

To the fullest extent permitted by South African law, Wellness Satiety, its directors, and employees shall not be liable for any health complications, adverse allergic reactions, or lack of expected weight loss/satiety results arising from the consumption of our products, save for instances of gross negligence on our part as defined under the CPA.

12. Governing law and jurisdiction.

These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa. Any legal disputes arising from these Terms or the purchase of our products will be subject to the non-exclusive jurisdiction of the High Court of South Africa.
